Well, if your school has a policy that forbids that kind of thing, they probably have a good case.

It may be harsh, but it would be well within their rights.

They're trying to get me expelled, I'm not backing down.... I feel too strong on this.

They're trying to expel you for using proxies?  It seems extremely harsh to me, but it is sort of up to them.

I'd suggest doing something like "I know it was wrong and I won't do it again."  I got in some pretty severe trouble in HS over "abusing" computers and it was over something far, far worse than using proxies, in my opinion.  The tech coordinator and the principle decided that suspending my account for all non-academic purposes and two days of in-school suspension were sufficient.

It's their job to interpret and enforce the rules. Not yours. Don't try to do their job -- they won't listen and it won't help your case.

It's best to do what sidoh said: get on your knees and repent. That's what they want to see you do. If you do that, they may feel nice enough to let you off with a lesser punishment.

As a reasonably close example to this situation: my friend brought a knife with him on a trip to Europe for choir. He is now expelled and attending an alternative educational institute. As a comparison, kids who bought knives and swords in choir in Europe never even got a slap on the wrist. Hell, a few years ago the principal bought a sword.

At the hearing, my friend tried to establish credibility and used a damn good argument/train of logic to prove that the expulsion was unwarranted and unnecessary. They even commented on his ability to argue. He had people at the hearing -- including witnesses and chaperons who said they didn't feel threatened by him and that he was a good kid. He, however, only acknowledged that what he did was wrong. As far as I know, he never once apologized and promised to be a good boy or anything sappy like that.

He still got expelled.

That analogy doesn't even make sense.  Why would a water balloon be especially bloated on a hot summer's day? For your sake, I hope there wasn't too much logic testing on your LSAT.

I'm sorry, I can't properly explain and elaborate on everything, It's just I've been talking about it all day to my parents, teachers, students and everyone inbetween.. and personally it gets tiring, but I just don't feel like backing down... It's what everyone does in a situation like this? They're invading my rights..

I don't know about the rules, or why they wouldn't be able to, without more information.

However, you didn't "go to a site", you circumvented their security controls, and allowed others to circumvent those controls as well. That's typically against the rules/policy.

Technically, if you really think about it, I didn't breach their security, the kids who used it did.

and, I'm going to fight it because, the school can't manipulate what I do at my house... kids just decided to use my website at school.

The first says that he didn't use it, and the second says he did.

I don't think we can really say anything useful without hearing the story.

In either case, however, he's still intentionally circumventing the school's policies, whether it's for himself or for others, which means that my previous post stands.

Actually, he apologized. And I disagree with this entire post.  I think he would have been much better off with a lawyer.

According to a text message conversation, he didn't appeal to that side much at all, telling me he only acknowledged that he broke a rule and wouldn't do it again.

I'll quote him. "I actually didn't go for pathos too hard." As the response to my text associating emotions with pathos, that would imply he didn't really touch on that as much as he should have.

And yes, the laywer route will prevent you from being expelled altogether. But it's pricey, and he isn't very rich. And while you may say "it will only cost an hour" like every other retard that thinks that way, it's any part of an hour is an hour. And you'd have to meet with him and plan stuff ($$$) then he has to file papers and write letters ($$$) then he has to show up to the case ($$$) so it adds up.

And how long was his case? 2-3 hours without the lawyer? If they don't try and settle outside the hearing, it's going to add up very, very quickly.

And I told him from the day he found out he was being expelled to get a fucking lawyer. And nobody listened to me. Suddenly, people started listening and telling him the same thing. And nearly a few months later, and he still never got one.

If your proxy does not control who sees what, and hosting the proxy enables students to see things that are otherwise illegal (for example, pornography or ways to get prescription meds without a scrip), you could potentially be pressed for the contribution of the delinquency of a minor.

Actually, that's true. It'd be similar to buying alcohol for minors, I think.
