Blaming the "proximate cause" is ridiculous, and I can't believe I actually feel the need to explain why:
If you brought a bunch of friends to a shooting range, and one of them runs out to his target in the middle of an "open fire", and gets shot and killed, you are the proximate cause. Are you to blame? No, your friend is for being a fucking moron.
Really?  You don't think that that would in some way come up in the American legal system?  Really??

What you suggested was prompted by what Joe suggested, so Joe's suggestion was in the first place, and yours was second.
