Logical question like riddle

This is one I made up while thinking about Texas Justice, I read up alot on americans, the shit you guys do is really out there.

Anyway I have given some thought to the death penatly and punishment/crime, how to stop it and if it could be stopped.

Now heres the "logical" riddle I thought of:

The lawmakers of Texas have instated a new capital punishment rule, the punishment MUST fit the crime so they come up with the "eye for an eye law" which means what it literally is, if you slit someone's throat the same is done to you, if you strangeld someone you will be hanged, if you stabbed someone you will be stabbed and so forth.
The question is now, if this punishment were real, would the rate of murders go down, stay the same or would people simply kill others more *nicely*, IE shot in the head?

Wrap your mind around that one and give me logical arguments.

Personally, I'm pretty sure it would have little affect on the murder rate.

Usually, when you're going to murder someone, you either:

1) Don't care about the consequences -- you just want the person you're killing dead

2) Sick in the head and kill people for fun

3) Think you can dodge the consequences through subtlety, "hiding the clues" and hiding from the authorities.

In 1's case, I don't think changing the punishment system would have any noticeable affect on the murder rates.  People who kill for reason 2 generally follow the traits of people who kill for reason 3 as well as the enjoyment of murdering beings.  In both 2 and 3's cases, I don't think the murder rates or methods would be changed much.

I'm sure it would have some measurable affect, but I really don't think it would be worth the lack of humanity it would carry with it.

Ok so rule out crime rate going down, now if a murderer knows the consequences when thinking about killing someone, would he change the way he was going to murder?

Given the motives behind murder, I kind of doubt it would have much effect.

Again, I don't think it would be worth the uncivil repercussions it would produce.

There has to be something riddle worthy in this eye for an eye riddle, I kind of just thought it up on the spot and wanted to see what you guys thought. If you can think of a way to make a twist on it and turn it into a true riddle i'd like that alot.

This particular question is pretty subjective, but that's OK.  I think it shows a good amount about how you feel in certain areas.

I've heard a very similar question before, although I can't remember the answer.  I am pretty sure it's a trick question, though.  Find the way to kill somebody in such a way that it's impossible to kill you that way.

Personally, I'd force them to commit suicide.  Then, I didn't technically kill them, right? :)

I'm pretty sure that's not the right answer, but there IS one that I can't think of  it.. :(

Get them to do extremely dangerous and risky missions? Like putting out forest fires with their hair, etc.
