The ultimate issue will come down to this: is there a substantial likelihood that people looking for the Cisco product – or a product with capabilities like the Cisco product – would be confused by the Apple entry into the market?

It depends if they figure that people could get confused between a VOIP Phone and a Cell Phone. Like, there's a reason that "Windows Vista" can have the same name as a Window store: they are distinct.
Whatever happens, it's going to work out for Apple.
