71y/o retired Marine was finishing eating when 2 dudes came in to rob the joint with masks and guns.
They tried to force him into bathroom, he distracted them and pulled out his .45 firing 7 shots.  One guy got hit in the head and stomach.

Did he legally have the right to shoot the person?

If so, I can still see him going to jail for possessing a concealed weapon, unless his Marine service and training gives him that right.

They were armed, masked, stealing his money, and man-hanlding him from what the article says.  That, in my mind, would be a threat to his life = okey dokey to lay those bastards out

Depend on state law.  In Arizona, they can: 13-406 and 13-408 ARS.
