It's probably because they bought the used game when it was still relatively new, so they'd be losing money (or would be making very little profit) if they dropped it below the price of the new one. They probably just take the used ones out of stock after some amount of time.
But yeah, that's pretty stupid.

Retail and OEM are different products. OEM drives generally don't come in a nice box with manuals and screws. It's just the bare drive.
